HR Management in Sierra Leone

Employment in Sierra Leone is governed by the Employment Act 2023, which replaced older labour laws and sets minimum standards for contracts, hours, leave and termination. Trade group agreements often add better terms. Here is what employers need to know.

Leave entitlements

The Employment Act 2023 sets the minimum leave rights. The length of annual and sick leave is largely set by the employment contract and the relevant trade group (collective) agreement.

1 month's pay
Annual leave allowance

After 1 year of continuous service, at least one month's basic salary as leave allowance for each completed year, on top of paid annual leave.

14 weeks
Maternity leave

At least 14 weeks on full pay, with the right to return to the same job. Dismissal during pregnancy or maternity leave is prohibited.

2 weeks
Paternity leave

On full pay on the birth of a child, with one week's written notice. Limited to one paternity leave a year.

Annual and sick leave
  • Annual leave – every worker is entitled to annual leave, which can be taken in instalments. The number of days is set by the contract or trade group agreement.
  • Leave not taken – if the employer prevents a worker from taking annual leave because of work needs, the worker is entitled to one and a half months' basic salary in lieu.
  • Sick leave – granted in line with the Act, the contract and collective agreements. The worker must notify the employer and provide a medical certificate.

Pay & working hours

A national minimum wage applies to all workers, and an agreement to pay less is void. Trade group agreements set higher minimum rates for many sectors. Check the current national rate with the Ministry of Employment, Labour and Social Security.

Normal working day

Can be extended by agreement to no more than 10 hours a day. At least 30 minutes' break for a day of 8 hours or more.

40 / 48 hours
Normal / maximum week

Normal hours are 40 a week; workers cannot be required to work more than 48. At least 1 rest day after 5 consecutive working days.

+50% / +100%
Overtime premium

Without a written agreement: 50% extra on weekdays and 100% extra on weekends and public holidays.

Other pay rules
  • Night work – paid at least 30% above the day rate.
  • Allowances – the Act lists allowances payable where applicable, such as transport, housing, medical and risk allowances, with amounts set by agreement or regulation.
  • Records – employers must keep records of wages and particulars of employment.

Income tax

Employers deduct Pay-As-You-Earn (PAYE) tax from employees' salaries and allowances every month and pay it to the National Revenue Authority (NRA). The tax year runs from 1 January to 31 December.

Resident individual PAYE bands as published by the NRA, shown in new leones (NLe) after the 2022 redenomination. Non-residents are taxed at a flat 25%. Confirm current bands with the NRA.

The employee's 5% NASSIT contribution is deducted from basic salary before PAYE is calculated, and a non-taxable allowance threshold applies to cash allowances. A leave allowance is only taxed on the amount above one month's basic salary. Benefits in kind are taxed at the employee's highest marginal rate.

Employer payroll costs

The main statutory payroll cost is the social security contribution to the National Social Security and Insurance Trust (NASSIT), which covers contract, part-time and casual employees as well as permanent staff.

Payment deadline

The combined 15% must be paid to NASSIT within 15 days after the end of each month. Late payment attracts interest and penalties.

End of service benefits

Workers with at least one year of continuous service are entitled to severance pay or an end of service benefit when they leave, whether by termination (other than for gross misconduct), resignation, retirement or death. Budget for this liability as service builds up.

Ending employment

The Employment Act 2023 requires a valid reason for dismissal, and the employer bears the burden of justifying it. Workers can bring claims of unfair termination, and summary dismissal is limited to serious misconduct.

  • Resignation by the worker
  • Mutual agreement
  • Expiry of a fixed-term contract
  • Retirement
  • Fair dismissal for misconduct or capacity
  • Redundancy
Notice, severance and redundancy
  • Notice – either party can end an open-ended contract with 1 month's notice in writing, or 1 month's basic salary in lieu. Longer notice can be agreed. No notice is needed for serious misconduct.
  • Probation – either party can end a probationary contract with at least 7 days' notice or 7 days' wages in lieu.
  • End of service benefit – payable after 1 year of service within one month of leaving, at the level set by the contract or collective agreement.
  • Redundancy – employers must inform the Labour Commissioner and the trade union at least 3 months in advance, consult on alternatives, apply "last in, first out" subject to merit, and negotiate redundancy payments.
  • Collective termination – special rules apply when an employer plans to terminate at least 5% of its workers within 4 weeks.

On termination, the employer must give the worker a certificate of service, and outstanding annual leave cannot be counted as part of the notice period.

Public holidays

Sierra Leone observes Christian and Muslim holidays alongside national days. Muslim holidays follow the lunar calendar and move each year. The government can also declare additional holidays.

Hiring & contracts

Contracts can be written or oral, but every worker is entitled to written particulars of employment from the employer. Employers must also register their workplace with the Labour Commissioner and notify the Commissioner of job vacancies.

Probation and fixed-term limits
  • Probation – no longer than 6 months, and a worker can only be put on probation once unless later hired for substantially different work.
  • Fixed-term contracts – contracts of less than 6 months can be renewed only once. Fixed-term workers with 12 months' continuous service are entitled to the benefits under the relevant trade group agreement.
  • NASSIT – register the business and each employee with NASSIT and start paying contributions from the first month.
  • Foreign workers – need a work permit under the Work Permit Act 2023.
