Leave Policy

Maternity Leave

Female employees are entitled to 126 calendar days of maternity leave upon the birth of a child without complications and 140 calendar days upon the birth of two or more children or if complications occurred during the birth. Employees who adopted a newborn directly from the maternity ward are entitled to 56 calendar days of maternity leave.
When giving birth to a child without complications, it is necessary to take 70 days before the expected date of delivery and 56 days after birth. When giving birth to two or more children or if complications occurred during childbirth, it is necessary to take 70 days before the expected date of delivery and 70 days after birth.
This vacation is paid by the social security fund at 100% of the employee’s regular salary. The employee cannot extend the vacation.

Paternity Leave

Paternity leave is not regulated by law in Ukraine. However, employees may be entitled to childcare leave.

Childcare leave:
Employees with children under 3 years of age are entitled to up to 3 years of paid childcare leave. This vacation is paid by social insurance at the rate of UAH 41,280 divided by 36 months.
To take advantage of this leave, the employee must provide his employer with a birth certificate and confirmation that the child’s other parent has not taken such leave at his place of work.

Parental Leave

Parental leave is not regulated by law in Ukraine. However, employees may be entitled to maternity leave and paternity leave.

Sick Leave

Workers in Ukraine are entitled to sick leave based on the following criteria:

  • Temporary incapacity for work: 4 months without interruption from the start of the incapacity for work
  • Recurrent illness: 5 months due to the same illness or its complications in the last 12 months
    Tuberculosis: within 10 months from the time of onset

The employee must have been employed for at least 6 months and have paid social security contributions.
Sick leave is paid as follows:
1-5 days: 100% of the employee’s regular salary is paid by the employer
6 or more days: 50 to 100% of the employee’s regular salary is paid by the Social Security Fund, depending on the length of the employment relationship

Pay & Tax

Minimum Wage Requirements

The minimum wage is 7100 UAH per month.

Individual Income Tax

The individual income tax rate in Ukraine is 18%. Income tax is calculated at a flat rate.

Payroll Cost

The cost to the employer is generally estimated at 22% of the employee’s wages.

  • Mandatory state social insurance – 22%
  • One-time mandatory processing fee for wet ink employment contract – USD 80

Overtime Pay & Maximum Hours

The standard working hours are 8 hours per day and 40 hours per week. The normal working week lasts from Monday to Friday.

Termination

Termination Requirements

Dismissals must take into account complex rules and the regulations of the country in which an employee is employed. Off-boarding is always carried out by the employer with the main participants. It may include ad hoc fees as well as required or recommended steps for specific termination cases.

Terminations in Ukraine can be complex. Outside the probationary period, the employer in Ukraine cannot terminate at will, and the termination must be for a valid reason. Proper terminations are:

  • Voluntary by the employee
  • By mutual agreement
  • Unilaterally by the employer due to:
    • Probationary period
    • Changes in production and work organization
    • Appearing at work in a state of intoxication
    • Incompatibility of the employee with the position for which he was hired
    • Performance due to lack of suitability for the job
    • Systematic failure of the employee to fulfill his or her duties
    • Failure to appear at work for more than four months in a row due to temporary incapacity to work
  • When the contract expires

Notice Period

The notice period depends on the reasons for the dismissal.

  • By mutual agreement – no notice period
  • During the trial period – 3 days notice period
  • Voluntary by the employee – 14 days’ notice
  • Unilaterally by the employer in the event of dismissal – 2 months’ notice

Severance for Employees

Severance pay is paid if an employee is not dismissed of their own accord. The amount of the severance payment depends on the circumstances surrounding the termination of the contract.

Statutory Time Off

Paid Time Off

Both full-time and part-time employees are entitled to at least 24 days of paid time off per year. PTO varies depending on the type of employee:

  • Employees of the first or second category of disabled – 30 days PTO
  • Employees of the third category of disability – 26 days of PTO
  • Employees under 18 – 31 days PTO
  • Seasonal workers – proportional to the hours worked

PTO eligibility is calculated monthly at 2 days per month. Employees are eligible for PTO after 6 months of work.

There are 12 public holidays celebrated in Ukraine. National holidays include:

Employment Contract Details

The contracts must be drawn up in Ukrainian and can be bilingual. They must be in writing and signed by both parties.

A contract must contain the following:

  • Place of work
  • Working hours
  • Break
  • Position
  • Rights and obligations
  • Amount of compensation
  • Validity

Probation Period

The probationary period is not mandatory. There is no minimum probation period. The maximum duration of the probationary period for employees is 90 days (3 months). For workers, the maximum duration of the probationary period is 1 month.
