Leave Policy

Maternity Leave

Eligible employees are entitled to 60 days of paid maternity leave at 100% of their regular salary. During this period, the worker will receive 334 TND from CNAM every month. The employer then tops up this amount until the employee receives her regular salary. The benefit is 30 days of paid vacation with the possibility of two 15-day extensions.

Paternity Leave

Eligible employees are entitled to 2 working days of paid leave in the event of the birth of a child. This is paid by the employer at 100% of the employee’s regular salary.

Parental Leave

There is no law on parental leave in Tunisia. However, employees may be entitled to maternity and paternity leave.

Sick Leave

Employees are entitled to 6 days of paid sick leave at 100% of their salary. Any absence longer than 6 days will be managed by the Caisse Nationale de l’Assurance Maladie (CNAM). The duration and compensation are calculated by the CNAM on a case-by-case basis.

Pay & Tax

Minimum Wage Requirements

The minimum monthly wage for full-time employees is 459.26 TND.

Individual Income Tax

Personal income tax ranges from 0% to 35%. Income tax is calculated at progressive rates. Several additional factors can affect overall rates, such as: the household status and the number of children.

*As of January 2020, the 0% SCC rate applies only to natural persons who exclusively receive salaries, wages, pensions and annuities and whose annual net income does not exceed 5,000 TND.

Payroll Cost

The cost to the employer is generally estimated at 17% of the employee’s salary.

Overtime Pay & Maximum Hours

The standard working hours are 8 hours per day and 40 hours per week. The normal working week lasts from Monday to Friday.

Paying for overtime is not mandatory and can be included in your salary. Hours outside of standard working hours are considered overtime. An employee can work a maximum of 20 hours of overtime per week. Depending on the agreement, employees receive between 150% and 200% of the hourly wage for additional hours.

Termination

Termination Requirements

Dismissals must take into account complex rules and the regulations of the country in which an employee is employed. Off-boarding is always carried out by the employer with the main participants. It may include ad hoc fees as well as required or recommended steps for specific termination cases.

Layoffs in Tunisia are complex. In Tunisia, employers cannot terminate at their own discretion outside of the probationary period and the termination must be for valid reasons. Employees have the right to appeal the termination before dismissal.

Compliant terminations are:

  • Voluntary by the employee
  • By mutual agreement
  • Unilaterally by the employer due to:
    • Probation period
    • Objective reasons
    • Dismissal for disciplinary reasons
    • Performance due to unsuitability for the position
  • When the contract expires

Notice Period

The notice period is mandatory and the minimum notice period is 1 month. It can be extended if this is specified in the employee agreement.

Severance for Employees

In Tunisia, all workers who are dismissed are entitled to severance pay, unless they are dismissed for disciplinary reasons. The severance payment amounts to 1 month’s salary per year of service.

Statutory Time Off

Paid Time Off

Full-time employees are entitled to at least 22 paid vacation days per year. This is accumulated at a rate of 1.83 days/month. Employees are entitled to vacation from day one and can use it accordingly.
Part-time employees are entitled to at least 10 days per year. This entitlement is credited with 0.83 days/month.

There are 12 national holidays in Tunisia that last 15 days.

Onboarding

Onboarding takes 3 working days after the customer signs the service description.

Documents must be completed 1 day before the start date.

Additional Info

Employment Contract Details

The contracts must be written in Arabic or French and can be bilingual. They must be in writing and signed by both parties. A contract must contain:

  • Surname
  • Start date
  • Length of employment
  • Job descrption
  • Conditions for Termination

Probation Period

The minimum duration of the probationary period is 30 days, the maximum duration of the probationary period is 180 days.
