Leave Policy
Maternity Leave
Pregnant employees are entitled to 126 days of paid leave. During this period, the employee receives 100% of her average salary for the last 12 months and social security is responsible for this remuneration.
You can use the leave module in IceHrm to manage maternity leave in Moldova.
Paternity Leave
Employees who have paid social security contributions for at least 9 months are entitled to 14 days of paid paternity leave. During this period, the employee receives 100% of his average salary for the last 3 months and social security is responsible for this remuneration.
Parental Leave
Employees are entitled to up to 36 months of parental leave. Both parents can decide how to divide the leave that should be taken after paternity and maternity leave. Both parents can take parental leave. Social security pays the salary during this period, which varies depending on the period.
Parental leave cannot be extended.

Sick Leave
Employees are entitled to up to 210 days of paid sick leave. Depending on the duration, this vacation is paid at different rates and by different payers:

Additional vacation
Employees are also entitled to vacation in the following cases:
- With the consent of the employer, employees can be granted special leave of up to 120 calendar days, which they can take for family or other important reasons. The vacation is unpaid
- Parents with two or more children under the age of 14 are legally entitled to at least four additional calendar days of paid vacation per year.
- Paid vacation in special cases:
1. Newlyweds – 3 days, starting from the date of registration of the marriage.
2. In the event of the death of parents, in-laws or children – 3 days.
3. In the death of second degree relatives – 1 day.
4. Parents (both mother and father) with children in grades 1 and 2 – 1 day at the beginning of the school year and 1 day at the end of the school year.
Pay & Tax
Minimum Wage Requirements
The minimum wage for workers in Moldova is 5,000 MDL/month for full-time employees.
Individual Income Tax
In Moldova, employees are taxed at a flat rate of 12%
Payroll Cost
The cost to the employer is generally estimated at 24% of the employee’s wages.

Overtime Pay & Maximum Hours
The standard working hours are 8 hours per day and 40 hours per week. The normal working week lasts from Monday to Friday.
Pay for overtime is mandatory. Hours outside of standard working hours are considered overtime. Employees can work a maximum of 2 hours of overtime. Employees receive compensation for additional hours:
- 150% of the hourly rate for the first 2 hours per week.
- 200% of the hourly rate for the following hours.
Termination
Termination Requirements
Terminations in Moldova can be complicated. In Moldova, employers cannot terminate at will outside of the probationary period, and the termination must be for a valid reason.
Compliant terminations are:
- Voluntary by the employee
- By mutual agreement
- Unilaterally by the employer due to:
1. Probationary period
2. Objective reasons
3. Disciplinary dismissal
4. Performance due to unsuitability for the position - When the contract expires
Notice Period
The minimum notice period is 30 days and increases depending on the type of termination.
- 30 days if termination is due to repeated non-performance
- 60 days if the termination is due to a reduction in headcount
Severance for Employees
In Moldova, all employees who are dismissed without cause are entitled to severance pay. The severance payment is 1 week of salary per year of service up to 6 months of basic salary.

Statutory Time Off
Paid Time Off
Both full-time and part-time employees are entitled to 21 days of paid time off (PTO) per year. PTO accrues monthly at 1.75 days per month. Employees are entitled to annual leave after six months of continuous employment.

Onboarding
Onboarding takes 2 business days after signing the SOW. Documents must be completed 1 day before the start date.

Employment Contract Details
The contracts can be in English and bilingual. They must be in writing and signed by both parties.
A contract must contain:
- Surname
- Start date
- Length of employment
- Job title
