Leave Policy

Maternity Leave

Employees who have worked 180 consecutive days are entitled to 14 weeks of paid vacation. During this period, the employee receives 100% of his salary and social security is responsible for this remuneration.

The employee can extend the vacation for an additional 3 weeks under certain conditions approved by the doctor.

Paternity Leave

There is currently no statutory paternity leave.

Parental Leave

Female employees are entitled to 1 calendar day of parental leave per year until the child is 14 years old.

Sick Leave

Employees are entitled to at least one week of sick leave per year, although the actual entitlement depends on several factors. This includes whether the illness is work-related or non-work-related and how long the employee has been employed by the company.

Minimum Wage Requirements

The minimum wage depends on the business sector.

Individual Income Tax

Personal Income Tax (PIT) ranges from 0% to 43%. Income tax is calculated at progressive rates. Salaries, wages, allowances, compensation and benefits in kind are considered employment income.

Payroll Cost

The cost to the employer is generally estimated at 24-28% of the employee’s salary. These costs depend on the category of the worker, which is determined by factors such as his monthly salary and qualifications. The category will be confirmed during the recruitment process.

  • Social Security Agency for Old Age Pensions (IPRES) 8%
    • Senior executives: + 4%
  • Mutual health insurance (IPM): contributions in the event of illness 4%

Overtime Pay & Maximum Hours

The standard working hours are 8 hours per day and 40 hours per week. The normal working week lasts from Monday to Friday.

Pay for overtime is mandatory. Hours that go beyond normal working hours are considered overtime. Employees receive compensation for additional hours:

  • 115% of the hourly rate for the first 8 hours of the week
  • 140% of the hourly rate from the 48th hour of the week
  • 160% of the hourly rate if the additional hours are night shifts
  • 200% of the hourly rate if it falls on a weekend or public holiday
  • 260% of the hourly rate for night shifts on public holidays

Termination

Termination Requirements

Layoffs in Senegal can be complicated. Outside the probationary period, the employer cannot terminate at will.

Compliant terminations are:

  • Voluntary by the employee
  • By mutual agreement
  • Unilaterally by the employer due to:
    • Probationary period
    • Objective reasons
    • Disciplinary dismissal
    • Performance due to unsuitability for the position
  • When the contract expires

Notice Period

The notice period depends on the category of employee and the length of employment.

  • More than 6 months of employment:
    • Management positions and similar positions: 3 months
    • Employees paid monthly: 1 month
    • Hourly employees: 8-15 days
  • More than 2 years of employment:
    • Management positions and similar positions: 3 months
    • Employees paid monthly: 1 month
    • Hourly wage employees: 15 days
  • More than 2 years of employment:
    • Management positions and similar positions: 3 months
    • Employees paid monthly: 1 month
    • Hourly wage employees: 1 month

Severance for Employees

Employees are entitled to severance pay after at least one year of continuous service, provided there is no serious misconduct. The severance payment amount, a percentage of the monthly salary, varies with the length of service: 25% annually in the first five years, 30% in the following five years and 40% after ten years.

Statutory Time Off

Paid Time Off

Both full-time and part-time employees are entitled to 24 days of paid time off (PTO) per year. PTO eligibility is calculated monthly at 2 days per month. Employees are entitled to annual leave after 12 months of work.

Onboarding takes 7 working days. Compliance documents must be completed 1 day before the start date.

Additional Info

Employment Contract Details

The contracts must be drawn up in French and can be bilingual. They must be in writing and signed by both parties. A contract must contain:

  • Surname
  • Start date
  • Length of employment
  • Job descrption
  • Conditions for termination of employment
  • Category of employee

Probation Period

The minimum duration of the probationary period is 30 days, the maximum duration of the probationary period is 90 days. The duration depends on the category of the employee, which is determined during the hiring process.

  • Management and similar positions: 90 days
  • Employees paid monthly: 30 days
  • Hourly employees: 8 days
