Leave Policy

Maternity Leave

The employee is entitled to 126 calendar days of paid vacation. During this period, social security pays 100% of the employee’s average salary for the previous three months, up to a maximum of 2,000 GEL for the entire period of maternity leave (this amount is subject to change).

Paternity Leave

Employees are entitled to at least 12 weeks of unpaid parental leave until the child is 5 years old. This leave can be taken in whole or in part, but may not be less than 2 weeks per year.

Sick Leave

Both full-time and part-time employees in Georgia are entitled to 40 consecutive calendar days or 60 calendar days within a six-month period of paid sick leave. The employer pays sick leave at 100% of the employee’s regular salary.

Pay & Tax

Minimum Wage Requirements

The monthly minimum wage is 20 GEL per month and has not been adjusted in the last 30 years.

The average minimum wage is around 1,300 GEL.

Individual Income Tax

Income tax is levied at a uniform rate of 20%.

Payroll Cost

The employer costs are usually estimated at 2% of the employee’s salary.

  • Accumulated pension program – 2.0%

Overtime Pay & Maximum Hours

The standard working hours are 8 hours per day and 40 hours per week. The normal working week lasts from Monday to Friday.

Pay for overtime is mandatory. Hours that go beyond the standard working hours agreed in the employment contract are considered overtime. Employees receive 125% of the hourly rate for overtime.

Termination

Termination Requirements

Dismissals must take into account complex rules and the regulations of the country in which an employee is employed. Off-boarding is always carried out by the employer with the main participants. It may include ad hoc fees as well as mandatory or recommended steps for specific termination cases.

Terminations in Georgia can be complex. In Georgia, employers cannot terminate at their own discretion outside of the probationary period, and the termination must be for just cause.

Proper terminations include:

  • Voluntary termination by the employee
  • Unilateral termination by the employer due to:
    1. Probation period
    2. Objective reasons
    3. Disciplinary dismissal
  • By expiry of the contract

Notice Period

The notice period depends on the type of termination.

  • Termination for good cause – 30 days
  • Cancellation – 30 days
  • Probationary period – no notice required

Severance for Employees

In Georgia, all employees who are laid off are entitled to severance pay. The severance payment amounts to 1 month of the basic salary.

If your employee resigns or is not entitled to severance pay, you will receive a refund of any unused amounts.

Statutory Time Off

Paid Time Off

Both full-time and part-time employees are entitled to 24 days of paid time off (PTO) per year. PTO is credited monthly at 2 days per month.
However, the employer has the right to reject vacation requests without giving reasons if the employee submits his request before he has worked at the company for 11 months.

Onboarding takes 3 working days. The documents must be completed 1 day before the start date.

Employment Contract Details

The contracts must be written in Georgian or English. They must be in writing and signed by both parties.

A contract must contain the following:

  • Date of start of work and duration of the employment relationship
  • Working hours and rest times
  • Type of activity: main or secondary employment
  • Position and type or description of work to be performed
  • Duration of paid and unpaid leave and the procedure for granting these leaves
  • Procedure for termination of employment by the employer and the employee

Probation Period

Probationary periods are not mandatory. The standard probation period is 90 days and the maximum probation period is 180 days.
